eBaymag Promo Terms and Conditions

What is the promotion?

Eligible sellers who have been invited to participate by email and/or by a message in My eBay Messages and/or see the offer in Promotional Offers in My eBay can create up to 1000 listings (for Starter and Basic store subscribers) and up to 10000 listings (for Premium/Featured, Anchor, Enterprise store subscribers) per calendar month on ebay.com, ebay.co.uk, ebay.de, ebay.fr, ebay.it and ebay.es, (excluding your store registration site) using eBaymag during the Promotion Period up to their selling limits allowance in any eligible category using fixed price format without paying an insertion fee per listing. Other fees still apply.

Who’s eligible?

Participation is linked to the seller’s account and is non-transferable. Sellers must be registered as a resident of India, Singapore, Thailand, Malaysia, Philippines, Indonesia, Vietnam or HIPO Region.

The promotion is valid only for one account that is the account with initial registration at the eligible site, even if the seller has active accounts at other eligible sites. Sellers need to have a “business” eBay account in order to be able to list items on eBay.de site. Sellers need to create their listings using eBaymag listing tool.

Only sellers who have an eBay seller account and have placed their credit card on file are eligible.

Only sellers whose accounts meet eBay’s minimum seller performance standards in each region (i.e., in all 4 programs: UK, US, DE, Global) are eligible. Please view your Seller Dashboard to verify whether your account is currently meeting the standards.

To take part in this promotion, sellers must have been invited to participate and have an active eBay Store subscription. Sellers that have been invited to participate will have received an email and/or a message in My eBay Messages and/or can see the offer in Promotional Offers in My eBay.

If seller has an existing store subscription and creates the listing using eBaymag tool, the insertion fees charged until December 31st 2024 11:59:59 PM will be refunded for the other 5 sites where the invited seller does not have a store up to a maximum of 1000 listings (for Starter and Basic store subscribers) and up to 10000 listings (for Premium/Featured, Anchor, Enterprise store subscribers) for each site. If any seller is a new store subscriber during the Promotion Period, the insertion fees charged from the moment the seller subscribed to December 31st 2024 11:59:59 PM will be refunded for the other 5 sites where the invited seller does not have a store up to a maximum of 1000 listings (for Starter and Basic store subscribers) and up to 10000 listings (for Premium/Featured, Anchor, Enterprise store subscribers) for each site.

If an invited seller upgrades their store during the Promotion Period s/he will remain/becomes eligible for the Promotional Offer. If an invited seller downgrades store subscription s/he might be subject to different number of free listings. If any sellers cancels their store subscription during the Promotion Period, then s/he is no longer eligible for the Promotional Offer.

Promotion Period

Sellers can accept this promotion at any time after they receive the marketing communication (e-mail) and/or message in My eBay Messages and/or saw the offer in Promotional Offers in My eBay till December 31st 2024 11:59:59 PM.

Promotion period — offer is valid until December 31st 2024 11:59:59 PM.

eBay has a right to terminate the Promotional Offer with prior notification to the invited sellers.

How do I get the promotional rate?

Sellers who have been invited to the promotion and list items using eBaymag with the seller’s qualifying eBay user ID will automatically receive zero insertion fees on their next listings.

The Promotional Offer only applies to items listed directly on the international eBay sites other than Store subscription site using the eBaymag listing tool.

Each invited seller gets up to 1000 insertion free listings (for Starter and Basic store subscribers) and up to 10000 listings (for Premuim/Featured, Anchor, Enterprise store subscribers) on ebay.com, ebay.co.uk, ebay.de, ebay.fr, ebay.it and ebay.es during the Promotion Period. For listings above this cap eBay will charge standard eBay fees that apply to the site on which the seller is listing.

Items must be listed during the Promotion Period in an eligible category using a listing in fixed price format. Your normal selling limits allowance still applies.

Any eligible item previously scheduled to start during the Promotion Period will qualify for the Promotional Offer, provided they meet the limits requirements.

For items listed in 2 categories, only insertion fee for the first category will be eligible for the Promotional Offer. Standard insertion fees will be charged for listing the same item in a second category, according to the standard eBay fees that apply to the site on which you are listing.

Any sellers who have NOT been invited to participate are not eligible.

Any sellers with accounts that are «Suspended» and/or «on hold» are excluded.

Sellers who have been invited to participate, but have not listed items using eBaymag are not eligible.

This Promotional Offer excludes:

• identical listings that do not comply with our Duplicate listings policy applicable to the site on which you’re listing;
• any listings that are above the limits described above on each eligible site;
• any listings that are relisted or renewed outside of the Promotion Period;
• any listings created during the Promotion Period that are scheduled to start after the Promotion Period;
• any listings created using not the eBaymag listing tool;
• any listings that don’t comply with our listing policies or prohibited and restricted items policies applicable to the site on which you’re listing.

Items listed on ebay.de site must be created in German language.

For items listed in 2 categories, only insertion fee for the first category will be eligible for the Promotional Offer. Standard insertion fees will be charged for listing the same item in a second category, according to the standard eBay fees that apply to the site on which you are listing.

This Promotional Offer isn't an offer to increase your selling limits allowance. You will only be able to receive the benefit of this Promotional Offer for those listings up to the limit of your selling allowance.

General Terms

By participating in this Promotion, you will be deemed to have acknowledged and agreed to comply with the following terms and conditions (the “Promotion T&Cs”):

1. Only the eBay Sellers who have been invited to participate by email and/or by a message in My eBay Messages and/or see the offer in their “Promotional Offers” in “My eBay” may participate in this Promotion.
2. If you participate in this Promotion, you may not participate in other eBay promotions during the Promotion Period.
3. Your participation does not guarantee that you will be entitled to any Incentive under this Promotion.
4. Participating eBay accounts are responsible for all its activities on eBay and remain solely liable for all risks relating thereto or arising therefrom.
5. You warrant and represent to eBay that all personal information that you provide to eBay is valid and accurate and acknowledge that if there is any fraud or inaccuracy in the information provided to us, or misappropriation of third-party information, eBay has the right, amongst other things, to disqualify any or all of your eBay accounts from participating in the Promotion.
6. All submission times shall be based on the time logs recorded in eBay systems. eBay will not be liable for any failure or delay, inaccuracy, or incompleteness of the information caused by the participant’s error or negligence, or any other types of failure that may occur during transmission.
7. eBay will not be liable for any operational, telecommunications, or technical errors or failures that may affect the participant’s ability to participate in this Promotion.
8. Employees and related personnel of eBay and its subsidiaries as well as related affiliates, and their immediate family members (spouse, parents, children, siblings, and their spouses) and any individuals living with them, are restricted from participating in this Promotion.
9. Incentives resulting from this Promotion cannot be transferred, redeemed, exchanged, or combined with other offers, discounts, or promotional offers.
10. Where applicable, Incentives will be paid in accordance with eBay Policy and such currency exchange rate as may be adopted by eBay at that time.
11. If applicable, eBay shall bear the remittance charges as may be imposed by any applicable payment service providers for remitting Incentives to you. You shall bear any charges that are imposed by such payment service provider for receiving such monies from eBay.
12. eBay shall not be liable for any loss or damages arising from any inaccurate price information of any listing participating in the Promotion.
13. eBay retains the right to pursue any claim for Incentive already paid to disqualified accounts at any time, or to seller accounts that do not agree to return any subsidies wrongly paid out by eBay under this Promotion.
14. You acknowledge that except for the Incentives, no other fees shall be payable by eBay to you, and no revenue sharing shall accrue to you under these Promotion T&Cs.
15. You shall bear your own costs and expenses relating or incidental to the operation of your eBay Accounts and/or the purchase of any services or features that you use on any eBay Site.
16. You may not disclose or publicise the Confidential Information to any third party, including to any current or former eBay Sellers or Buyers.
17. The restrictions under Paragraph 16) do not apply to the extent that you are required to disclose the Confidential Information (i) to your immediate family, (ii) to your attorney, accountant, auditor, tax preparer or financial advisor, or (iii) under applicable law or as otherwise required by any order of a court of competent jurisdiction. If you do disclose the Confidential Information, you must ensure the person to whom you disclose the Confidential Information is aware of, and fully complies with, the obligations under Paragraph 16) as if they were themselves subject to these Promotion T&Cs.
18. The obligations under Paragraph 16 continue after the expiration or termination of the Promotion.
19. This Promotion is offered pursuant to and governed by the eBay User Agreement and the terms and conditions set out therein.
20. You must at all times during the Promotion Period fully meet and comply with the eBay Policies, including the eBay User Agreement, Verified Rights Owner policies, Prohibited and Restricted item policies, and eBay User Privacy Notice. The eBay Policies are incorporated into these Promotion T&Cs by reference.
21. If there is any conflict, ambiguity or inconsistency between the Promotion T&Cs and the eBay Policies the eBay Policies shall take precedence.
22. eBay may at any time and in its sole discretion, immediately amend or terminate the Promotion by written notice to you.
23. eBay reserves the right to exclude you from the Promotion if your eBay Seller Account ever fall below the Minimum Required Seller Performance Standards.
24. eBay’s decisions on all matters relating to this Promotion (including the calculation of Incentives, or choice to disqualify you from the Promotion) shall be final and binding. No correspondence or appeal relating to the same shall be entertained.
25. The invitation to participate in the Promotion does not create any rights that are enforceable by any person who is not i) the eBay Seller identified in this email, ii) eBay, or iii) any of eBay’s affiliates.
26. eBay cannot guarantee the continuous operation of or access to the Promotion. You acknowledge and agree that (i) participation in the Promotion is at your own risk, (ii) that the Promotion is being provided to you on an "AS IS" and "AS AVAILABLE" basis, and (iii) to the maximum extent permitted by applicable law, eBay excludes all express or implied warranties including, but not limited to, all warranties as to the merchantability, fitness for a particular purpose and non-infringement of the Promotion.
27. The governing law and exclusive forum for the resolution of disputes shall be as follows:

Where Singapore Arbitration Centre is the forum for dispute resolution, the arbitration shall i) be conducted in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this Paragraph, ii) the seat of the arbitration shall be Singapore, iii) the tribunal shall consist of 1 arbitrator, iv) the language of the arbitration shall be English and v) the costs of the arbitration shall be borne equally by both Parties.
